Discussion Questions

Discuss your understanding of Week #5’s online learning material.  You are directed to pay particular attention to the area of discussion surrounding the different types of crimes; e.g. Mala in Se; Mala Prohibita; Felonies; and Misdemeanors. Also, select one (or more!) of the areas of discussion found through the links provided in the Reading, Viewing, Listening folder contained in Week #5’s Course Documents folder. 

 

Draft your original thoughts and inferences on the following questions to ponder:

 

      a.  In your words, what differentiates Mala in Se crimes from those determined to fall under the Mala Prohibita category?  Give examples.

 

      b.  In your words, after reviewing the following video on inchoate offenses, discuss your position as it relates to the potential penalties associate with these crimes.  Should an inchoate offense be punished as if the crime was fully executed, or should the penalty be applied to a lesser extent?  Why, or why not?
