
Contract Lesson 3- Consideration (Continued) – Bargain Promises Discussion

Direction: This is a two parts assignment which consist of three discussion questions, and three peer discussion posts reviews. Peer review will not be posted when order is placed since it not available. Please following direction as stated for discussion. Please format assignment as directed by professor. Cover page, Single space, times roman 12, double space between paragraphs. Each page must be numbered, and your last name and student number included on the upper left-hand corner of each page.
Discussion A
Under common law, “mutuality of obligation” was required for a bilateral contract. Draft an example of “a bilateral contract with mutuality of obligation”.
Discussion B
The Uniform Commercial Code (UCC) has deemphasized consideration for some types of contracts, such as a modification of a contract. Why do you think that the UCC has done this?
Discussion C
As a general rule, payment of an amount that is less than what is actually owed is not consideration for a full discharge of an obligation. However, there are many exceptions. Choose one of these exceptions and argue why it should be an exception.
