“The essence of a construction contract is that a contractor agrees to supply work and materials for the erection of a defined building or other works for the benefit of the employer” (Uff, 2013, p265).
Task
Outline the reasons why contracts are critical for construction projects. There should be information provided on the potential issues that can arise if a contract is not fully discharged.
Outline and clearly example the essential elements of a contract, using case law as necessary.
You should then imagine that during construction, certain issues arise. Discuss and clearly example with case law, the relevant areas of law that are covered by the issues outlined below, and the ramifications for the contracted parties in each case:
· Contractors decide to burn waste on-site without a license
· The site is broken into and materials are removed / disturbed
· Whilst the site is broken into, the perpetrator injures themselves
