Analysis

You will see that the court will examine all the facts presented in the case in view of the relevant rule(s) of law discussed above. There will be different perspectives, arguments, or sides presented to the court by the parties. In the analysis section, your goal is to demonstrate that you understand how the court applied the rule(s): what facts were considered to be relevant in light of this rule? What is the court’s interpretation of the rule? It is very important that you do NOT simply restate what the court said in its own analysis of the facts. You are analyzing what the court did in view of the rule in terms of what it means to you. You accomplish this by summarizing the court’s rationale in your own words. If you find legal terms that you do not understand in the case, use a dictionary, or law dictionary, such as “Black’s” to study its definition.
