2- Discussion

This is an informal Discussion Board. Think of it as attendance and an informal class discussion. There are no minimum word or paragraph requirements and posts can be informal. Students cannot earn points on these informal Discussion Boards, but failure to participate in a meaningful way will result in a one-point deduction from the tentative final grade.

Please share your responses to the question(s) posed about this week’s assignments before Thursday evening at 10pm.

1. Explain the reasoning of the majority in Berghuis v. Thompkins.

2. Then explain the reasoning of the dissenting justices in Berghuis v. Thompkins.

3. Finally, discuss and explain how you would have ruled, and why. In doing so, address Justice Sotomayor’s observation that in order to assert your right to remain silent, you cannot remain silent.
